1. Acceptance of Terms

By creating an account or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

2. Account Terms

You must be at least 13 years of age to use our Services. By creating an account, you represent that you meet this requirement. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@lokeytech.com if you suspect unauthorized access to your account.

3. Subscriptions and Payment

Certain features of our Services require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. Cancellations take effect at the end of the current billing period. Refunds are handled in accordance with the refund policies of the applicable app store or payment processor.

4. Intellectual Property

All content, features, and functionality of our Services — including but not limited to text, graphics, logos, software, exam content, and trademarks — are the exclusive property of Lokey Labs LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you generate through your use of the Services (such as study progress and notes).

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Services
• Scrape, harvest, or extract data from the Services by automated means
• Share your account credentials with any third party
• Reproduce, distribute, or publicly display any content from the Services without written permission
• Use the Services for any unlawful purpose or in violation of any applicable law
• Interfere with or disrupt the integrity or performance of the Services

6. Termination

You may terminate your account at any time by contacting us. Lokey Labs LLC reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

7. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Lokey Labs LLC does not guarantee any particular exam outcome. Our study tools are designed to assist with exam preparation, but passing any exam depends on many factors beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, Lokey Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Services. Our total aggregate liability for any claims arising under these Terms shall not exceed the total fees you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Lokey Labs LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the State of Florida.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page and may notify you via email or through the Services. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes.
